La subdivisión de inmuebles rurales en la provincia de Santa Fe

Abstract

La división de inmuebles rurales en la Provincia de Santa Fe se rige por dos (2) normativas con fundamentos jurídicos opuestos. La regulación del fraccionamiento parcelario es facultad de las provincias conforme lo estable el Código Civil y Comercial. Hasta el año 2021 primó la postura de permitir la subdivisión de inmuebles rurales en tanto no se vulnere la unidad económica agraria, basado en la capacidad de uso del suelo. En cambio, en la actualidad, es posible dividir los condominios rurales sin ningún tipo de limitación. En este breve trabajo damos cuenta del devenir de las subdivisiones rurales en nuestra provincia.

The division of rural real estate in the Province of Santa Fe is governed by two (2) regulations with opposing legal grounds. The regulation of parcel subdivision is the power of the provinces as established by the Civil and Commercial Code. Until 2021, the position of allowing the subdivision of rural properties prevailed as long as the agrarian economic unit is not violated, based on the land use capacity. On the other hand, at present, it is possible to divide rural condominiums without any type of limitation. In this brief work we give an account of the evolution of rural subdivisions in our province.
