El Código de Aguas bonaerense en la justicia contenciosa administrativa

Abstract

El trabajo intenta presentar en forma sintética conflictos que llegan a los juzgados contencioso administrativos del departamento judicial La Plata en los que, para su resolución, se encuentra en juego la aplicación de normas del Código de Aguas bonaerense o vinculadas al mismo. En línea con ello, y a modo de introducción a los casos, intentaremos hacer una somera referencia a la normativa vigente y que guarda vinculación con las cuestiones litigiosas, a efectos de facilitar su comprensión y su vinculación con el Código de Aguas. Trataremos brevemente las normas del código y otras vinculadas, referidas al control de la contaminación, permiso de vuelco, el régimen sancionatorio relativo a vuelcos, la remediación, las obras hidráulicas clandestinas, línea de rivera. Este trabajo sintetiza alguna parte de las tareas realizadas en el marco del proyecto de investigación “La problem{tica del agua ante el crecimiento poblacional y el modelo mundial de desarrollo vigente. Sus impactos jurídicos (11/J110)” de la C{tedra I de Derecho Agrario de la Facultad de Ciencias Jurídicas y Sociales, UNLP, Dirigido por el Profesor Leonardo F. Pastorino y codirigido por la Pofesora María de las Nieves Cenicacelaya.

This paper tries to present synthetically conflicts that come to the judicial department from La Plata litigious thedministrative courts, in which for their resolution the application of Aguas Bonaerense code norms or the ones linked to it is involved. Along the line of the aforementioned, in order to introduce the cases, we will briefly refer to the current regulations which are linked to the litigious questions to facilitate the comprehension of the cases and their connection with the Aguas code. we will briefly deal with the norms of the code and others which are linked, such as the control of pollution, dump permission, branning regime related to dump, remediación, the illegal hydraulic works, line rivera.
