La relación entre la justicia y política en la experiencia chilena: develando la realidad tras el mito

Abstract

Este artículo discute algunas mitologías sobre la forma en que se ha resuelto la relación entre Justicia y Política en Chile en el último medio siglo. Es acríticamente aceptado que, a diferencia de otros países de la región, Chile ha resuelto la separación Justicia y Política en términos clásicos de estricta división de poderes, donde cada esfera de poder constitucional actúa dentro del alcance de sus poderes y atribuciones, lejos del peligro que siempre atormenta la teoría constitucional de una posible “politización de la justicia” o “judicialización de la política" Este artículo demuestra que Chile ha consagrado constitucionalmente un modelo de separación de poderes que encapsula la actividad judicial al alcance de la solución de controversias de alcance jurídico, alejándolo de la Política como espacio de discusión de poder. Más aún, en la práctica ha existido y existe una relación más compleja entre Justicia y Política, con una influencia mutua que ha superado-de manera legítima e ilegítima-el modelo tradicional de separación de poderes.

This article discusses some mythology about the way in which the relationship between Justice and Politics has been resolved in Chile in the last half century.
