Propiedad Colectiva Indígena: conflictos por el uso de la tierra en la provincia de Corrientes

Abstract

En Latinoamérica, especialmente en Argentina, la identidad de los pueblos indígenas se encuentra íntimamente vinculada a sus demandas territoriales, siendo objeto de este trabajo la propiedad colectiva y sus implicancias en la provincia de Corrientes. Al formarse los Estado-Nación la cuestión indígena quedó sin una solución y la mayoría de las veces primó la negación de su existencia, conllevando indiferencia y violencia. (Alanda-Victoria, 2016). Diversos factores han incidido en las últimas décadas en la reforma de los Estados de América Latina dando lugar a transformaciones jurídicopolíticas que han permitido el creciente reconocimiento de los pueblos indígenas y de sus derechos, cuestión que se ve reflejada con la Reforma Constitucional de 1994 y la incorporación del Convenio 169 de la OIT entre otras normas nacionales e internacionales. A pesar de lo expuesto anteriormente, no existe en la provincia de Corrientes una normativa específica que regule esta materia, pese al reconocimiento a partir del año 2013 de algunas de sus comunidades indígenas por el INAI.

In Latin America, especially in Argentina, the identity of Indigenous Peoples is closely linked to their territorial demands, the object of this work being collective ownership and its implications in the Province of Corrientes. When the Nation-State was formed, the indigenous question was left without a solution and, most of the time, the denial of its existence prevailed, leading to indifference and violence (Alanda-Victoria, 2016). Several factors have influenced the reform of Latin American states in recent decades, leading to legal and political transformations that have allowed the growing recognition of indigenous peoples and their rights, a matter that is reflected in the Constitutional Reform of 1994 and the incorporation of ILO Convention 169 among other national and international standards. Despite the foregoing, there is no specific regulation in the Province of Corrientes that regulates this matter, despite the recognition, as of 2013, of some of its indigenous communities by the INAI.
