presente ponencia intenta poner en evidencia dos circunstancias producto de normas legislativas dictadas en la Provincia de Santa Fe en un lapso acotado de tiempo con un criterio totalmente opuesto y por supuesto con resultados antagónicos. Luego de un breve relato de los antecedentes legislativos en la materia, nos permitimos puntualizar estas dos circunstancias. Por un lado la norma que encontramos en el Decreto Reglamentario Nº 3872/14 que incorpora el concepto de Unidad Económica Discontinua (UED) que sin duda amplía y podemos decir «moderniza» el concepto de Unidad Económica, dando una posibilidad que consideramos positiva al titular de tierras que no se encuentran contiguas pero si a poca distancia una de otra. La otra norma legislativa analizada es la Ley N1 12749 sancionada el 20 de septiembre de 2007, y promulgada el 17 de octubre del mismo año, que suspendió por dos años de Unidad Económica que aquellos inmuebles rurales que a la fecha de la promulgación de la ley estén inscriptos en condominio o se encontrare iniciado un proceso sucesorio del que derive adjudicación en condominio conforme a los términos de la Ley Nº 9319. La aplicación de esta ley viendo el resultado obtenido durante el lapso de vigencia de la misma fue sin duda negativo. Se intenta poner de relieve como dos normas legislativas dictadas en la Provincia de Santa Fe han tenido dos enfoques opuestos ya que una propende a justificar aún más la Unidad Económica y la otra lisa y llanamente por dos años la suspende con los resultados señalados.

This paper seeks to highlight two circumstances resulting from legislative regulations issued in the Province of Santa Fe in a limited period of time with a totally opposite approach and of course with antagonistic results. After a brief account of the legislative history in the matter, we allow ourselves to point out these two circumstances. On the one hand the norm that we find in Regulatory Decree No. 3872/14 that incorporates the concept of Discontinued Economic Unit (UED) that undoubtedly extends and we can say «modernizes» the concept of Economic Unity, giving a possibility that we consider positive to the holder of lands that are not contiguous but close to each other. The other legislative rule analyzed is Law No. 12749 enacted on September 20, 2007, and promulgated on October 17 of the same year, which suspended for two years of Economic Unit that those rural properties that at the date of the enactment of the law are registered in condominium or will be initiated a succession process from which a condominium adjudication derives in accordance with the terms of Law No. 9319. The application of this law seeing the result obtained during the period of validity of it was undoubtedly negative. An attempt is made to highlight how two legislative norms issued in the Province of Santa Fe have had two opposed approaches, since one tends to justify the Economic Unit even more and the other simply and for two years suspends it with the indicated results.
