Revisitando la opinión consultiva OC-28/21 de la Corte Interamericana de Derechos Humanos: la reelección indefinida entre el derecho y la política

Abstract

La Declaración Americana de los Derechos y Deberes del Hombre establece el derecho a participar en el gobierno, lo que incluye el derecho a ser elegido. Sin embargo, la reelección indefinida presidencial puede tensionar con los principios republicanos, que postulan la separación de poderes y la limitación del poder del Estado. En 2021, la Corte Interamericana de Derechos Humanos (Corte IDH) emitió la Opinión Consultiva OC-28/21, en la que concluyó que la reelección indefinida presidencial no es un derecho humano autónomo y que puede socavar el sistema democrático. La Corte IDH argumentó que la reelección indefinida puede concentrar demasiado poder en el presidente, dificultar la participación política de otros actores y limitar la separación de poderes. La Opinión Consultiva de la Corte IDH es un paso importante en la protección de la democracia en las Américas. Sin embargo, es importante reconocer que el debate sobre la reelección indefinida presidencial es complejo y no tiene una respuesta fácil pues el debate no puede ser simplemente juridizado. En última instancia, la decisión sobre si permitir o no la reelección indefinida es una decisión política que debe tomarse en cada país.

The American Declaration of the Rights and Duties of Man establishes the right to participate in government, including the right to be elected. However, indefinite presidential reelection may conflict with republican principles advocating for the separation of powers and the limitation of state power. In 2021, the Inter-American Court of Human Rights (I/A Court H.R.) issued an Advisory Opinion OC-28/21, concluding that indefinite presidential reelection is not an autonomous human right and can undermine the democratic system. The I/A Court H.R. argued that indefinite reelection could centralize too much power in the president, hinder the political participation of other actors, and limit the separation of powers. The I/A Court H.R. Advisory Opinion is a significant step in safeguarding democracy in the Americas. Nevertheless, it's crucial to recognize that the debate on indefinite presidential reelection is complex and lacks a straightforward answer as it cannot be solely juridical. Ultimately, the decision to allow or prohibit indefinite reelection is a political choice that each country must make.
