Femicidio: la importancia de su tipificación en el derecho penal argentino

Abstract

El presente trabajo aborda con perspectiva de género la incorporación de la figura del femicidio en el Código Penal Argentino, a partir de historizar el concepto, teniendo en cuenta losestándares internacionales de la debida diligencia reforzada para la investigación de estos casos. Se realiza un análisis de la importancia y consecuencias a nivel provincial de la adhesión alProtocolo para la investigación y litigio de casos de muertes violentas de mujeres (Protocolo UFEM), y las medidas adoptadas por la Suprema Corte de la Provincia de Buenos Aires y el Ministerio Público de la Provincia de Buenos Aires.Reconocer la importancia de analizar los casos de manera compleja atendiendo a las relaciones de poder históricamente generizadas, es fundamental para que accedan a la justicia, cada vez más, las mujeres y las familias de víctimas de femicidios.

This article addresses with gender perspective the incorporation of the figure of femicide in the Argentinian Penal Code. After a brief historization of the concept, we describe the international standards of enhanced due diligence for the investigation of these cases. We analyse the importance and the consequences at the Provincial level of adhering to the Protocol for the investigation and litigation of cases of violent deaths of women (UFEM Protocol) and the measures adopted by the Supreme Court of the Province of Buenos Aires and the Public Ministry of the Province of Buenos Aires, as well as by the Public Prosecutor's Office of Cassation.Recognizing the importance of analyzing cases in a complex manner in the light of historicallygenerated power relations is essential for women and the families of victims of femicides to haveaccess to justice.
