Enfrentando la opacidad de la institución judicial

Abstract

La administración de justicia es una institución poco estudiada, particularmente en las sociedades periféricas y semi-periféricas. Esto se debe en gran parte a la dificultad que enfrentan los investigadores sociales para acceder a la institución judicial. Sin embargo, en las últimas décadas se ha comenzado a revertir esta situación. Esta relativa “apertura” de la institución está íntimamente relacionada con las constantes reformas a las que se ha visto sometida durante estos años. De todas formas, muchos de estos estudios son llevados a cabo, o encargados, por los propios promotores de los programas de reforma y, en consecuencia, adolecen de un sesgo que impide un abordaje despojado de preconceptos sobre cómo la institución debería funcionar. El presente artículo presenta como ejemplo de este sesgo la caracterización por los reformadores del expediente judicial en la administración de justicia bonaerense. El desafio es estudiar a la administración de justicia desde una postura crítica y reflexiva que busque comprender a la institución judicial sin dejar de cuestionar los valores hegemónicos que imponen el imaginario de lo deseable. Los trabajos presentados en este número de Sortuz: OñatiJournal of Emergent Socio-Legal Studiesparten de esta actitud críticabuscandotraer a la luz, por una parte, las relaciones entre la institución judicial y los poderes políticos, sociales y económicos de la sociedad, y por la otra, las complejas relaciones entre los actores judiciales que tienen lugar dentro de la institución.

The administration of justice is a poorly studied institution, particularly in peripheral and semi-peripheral societies. This is due mostly to the difficulty that social scientists face when trying to access the judicial institution. However, in recent decades this situation has begun to be reversed. This relative "openness" of the institution is closely related to the ongoing reforms that have been carried out over the last years. However, many of these studies are conducted or commissioned by the promoters of the reform programs themselves and suffer, therefore, from a bias that prevents addressing preconceptions about how the institution should work. This article presents the characterization of the judicial files in the administration of justice of Buenos Aires made by reformers as an example of this bias. The challenge is to study the administration of justice from a critical and reflective approach that seeks to understand it while questioning the hegemonic values that impose the ideas of the desirable. The papers presented in this issue of Sortuz: Journal of Emergent Oñati Socio-Legal Studies adopt a critical approach and attempt to bring light to, on the one hand, the relations between the judicial institution and the political, social and economic forces of society, and on the other hand, the complex relationships between the judicial actors that take place inside the institution.
