Vigencia del positivismo en el sistema penal argentino: la noción de “peligrosidad” como justificativo para la aplicación de medidas de seguridad a personas con padecimiento mental

Abstract

Este trabajo se inscribe en la investigación realizada con motivo de la tesis de maestría en Comunicación y Criminología, Facultad de Periodismo y comunicación Social, UNLP. El artículo 34 del Código Penal Argentino, en su primer artículo, plantea como “tratamiento” de personas con padecimiento mental que han cometido un un delito, medidas de seguridad. Éstas que se toman bajo la presunción de peligrosidad del sujeto, y que resulta ilimitada en el tiempo. La hipótesis de trabajo, es que cuando se apela al concepto de peligrosidad para aplicar medidas de seguridad en forma anticipatoria a un hecho, por tener en cuenta ciertas características del sujeto, se va contra derecho. Además, la declaración de inimputabilidad se hace previo a iniciar el proceso judicial por el que podrían encontrar a un sujeto culpable o inocente de un hecho, considerando al sujeto irresponsable pero aplicándosele una medida de seguridad, lo cual resulta anticonstucional, dado que se le aplica al sujeto una pena pero sin culpabilidad, es decir, sin delito. Intentaremos dar cuenta de estas afirmaciones a partir de una conceptualización teórica y del análisis del “Fallo Gramajo”, asimismo, reservaremos un apartado para trabajar el tratamiento que hacen los medios del “loco peligroso”.

This work is part of the research carried out on the occasion of the master’s thesis in Communication and Criminology, Faculty of Journalism and Social Communication, UNLP. These are taken under the presumption of danger of the subject, and that is unlimited in time. The working hypothesis is that when one appeals to the concept of dangerousness to apply security measures in an anticipatory way to a fact, to take into account certain characteristics of the subject, it goes against right. In addition, the declaration of incompetence is made prior to initiating the judicial process by which they could find a subject guilty or innocent of a fact, considering the subject irresponsible but applying a security measure, which is unconstitutional, given that it applies To the subject a punishment but without guilty, that is to say, without crime. We will attempt to account for these claims from a theoretical conceptualization and analysis of the “Gramajo Failure”, likewise, we will reserve a section to work on the treatment of the means of the “dangerous madman”.
