¿Qué sucede con la responsabilidad penal juvenil y políticas públicas de promoción, y protección de derechos para niñas, niños y jóvenes en Argentina?

Abstract

En nuestro país, la disputa sobre la baja de edad de punibilidad emerge recurrentemente en la escena pública. En este sentido, haciendo un relevamiento de material institucional y un registro mediático1 podemos dar cuenta de la forma periódica en la que el tema es discutido. Reconstruyendo la historia de este problema identificamos que las distintas tentativas que tienen como objetivo modificar el régimen penal juvenil se circunscriben en un entramado relacional en el que se asocia permanentemente la inseguridad con jóvenes de sectores populares. Bajar la edad de punibilidad se ha constituido en una reiterada propuesta que retoma la necesidad de modificar la normativa vigente, pero que simultáneamente avanza en aspectos que ponen alerta a organismos de derechos humanos, en general, y de defensa de los derechos de las niñas, niños y jóvenes, en particular. En este marco, para a dar cuenta de esta trama de interacciones, reconstruiremos algunas discusiones y situaciones respecto a la relación juventudes y seguridad, los diferentes marcos jurídicos en materia responsabilidad penal juvenil y políticas públicas de promoción, y protección de derechos para niñas, niños y jóvenes en la Argentina. Es decir, reconoceremos algunas dimensiones del contexto en el que se emplaza el tema en cuestión.

In our country, the dispute over the lowering of the age of punishment repeatedly emerges on the public scene. In this sense, making a survey of institutional material and a media record we can account for the repeated way in which the issue is discussed. Reconstructing the history of this problem, we identify that the differents attempts that aim to modify the juvenile penal regime are circumscribed in a relational framework in which insecurity is permanently associated with youth from popular sectors. Lowering the age of punishment has become a reiterated proposal that takes up the need to modify current regulations, but that simultaneously advances in aspects that alert human rights organizations, in general, and the defense of the rights of girls, children and young people, in particular. In this framework, to account for this network of interactions, we will reconstruct some discussions and situations regarding the relationship between youth and security, the different legal frameworks on juvenile criminal responsibility and public policies for the promotion, and protection of rights for girls, boys and young people in Argentina. That is, we will recognize some dimensions of the context in which the issue in question is located.
