"Conflicto de intereses" en investigaciones biomédicas

Abstract

El objetivo general del presente trabajo es el análisis del "conflicto de intereses" en las investigaciones biomédicas en países en desarrollo. De acuerdo con Thompson , el conflicto de intereses se produce cuando los intereses secundarios (beneficios económicos, búsqueda de prestigio, entre otros) influyen en los intereses primarios (protección de los sujetos de investigación, obtención de conocimiento seguro). Dicho conflicto no es sólo individual, sino también institucional. En función de esclarecer el mismo, comenzaré señalando los nuevos rasgos que revisten dichas investigaciones en el contexto actual. Posteriormente, me centraré en la identificación de los intereses en conflicto y en la identificación de los actores. En segundo lugar, y siguiendo a Goodin, redefiniré el concepto de vulnerabilidad en investigaciones, señalando las relaciones de vulnerabilidad en países en desarrollo. En tercer lugar, me detendré en los "comités de ética independientes", mostrando, a través del concepto de "libertad como no dominación" (Pettit) los problemas estructurales de los citados comités. Por último, avanzando en la definición de libertad real (Van Parijs-Elgarte) iv y en la determinación de las responsabilidades específicas (compañía) y sociales (Estado) en investigación en seres humanos, propondré algunas estrategias para la regulación del conflicto de intereses en el marco de guías éticas en investigaciones biomédicas.

The aim of the present paper is to analyse "conflict of interests" in biomedical research in developing countries. According to Thompson, "a conflict of interest is a set of conditions in which professional judgment concerning a primary interest (such as a patient's welfare or the validity of research) tends to be unduly influenced by a secondary interest such as financial gain". The conflict is not only individual, but also institutional. In order to clarify it, I will start showing some of the new characteristics of biomedical research in the current context. First, I will focus on the identification of the interests in conflict and the main actors involved in this process. Second, following Goodin, I will redefine the concept of vulnerability in research, pointing out some vulnerability relationships in developing countries. Third, I will study the "independent ethics committee", showing, in view of the concept of freedom as non- domination (Pettit), the structural problems of the aforementioned committees. Finally, going beyond the concept of freedom as non-domination, I will introduce a positive definition of real freedom (Van Parijs/Elgarte) and the determination of specific (companies) and social (State) responsibilities in research on human beings, in order to suggest some strategies for the regulation and prevention of conflicts of interests , and suggest some ethical guidelines for biomedical research.
