Una crítica a la visión del poder en el discurso de los derechos humanos

Abstract

El discurso de los derechos humanos es pensado por los sectores sociales progresistas como un instrumento eficaz para luchar contra la opresión y, el Sistema Interamericano de derechos humanos es, probablemente, uno de los sistemas con mayor legitimidad. En este artículo se propone problematizar los fundamentos ideológicos de los derechos humanos y reflexionar, desde una perspectiva crítica, sobre los alcances emancipatorios de este discurso. Se argumenta que los derechos humanos están atravesados por un sesgo sobre el funcionamiento del poder y se estructuran sobre un modelo ilusorio que reposa casi exclusivamente en los Estados. Este discurso se vuelve ineficaz a los fines prometidos y actúa ocultando el verdadero funcionamiento del poder, y, además, reproduciéndolo. Se sostiene que no es posible pensar al derecho a partir de la norma escrita, sino que es necesario observar las estructuras económicas y políticas que lo sustentan, a partir del análisis del Sistema Interamericano, sus fundamentos ideológicos, su estructura institucional y su financiamiento. Se abordará el funcionamiento del poder desde iniciada la etapa neoliberal, donde se conformó un modo de gobierno en el cual el Estado comparte las funciones de producción de normas y aplicación de sanciones con una multiplicidad de actores que no rinden cuentas.

Human rights discourse is considered by progressive social sectors as an efficient tool to fight oppression and the Inter-American System of Human Rights is probably one of the systems bearing the greatest legitimacy. This article aims at problematizing the ideological foundations of human rights and reflecting, from a critical perspective, upon the emancipatory scope that this discourse has. It is argued that human rights are biased when it comes to how power works and they are structured upon an illusionary model which rests almost exclusively on the States. This discourse thus becomes inefficient to its ends. Its actions, in fact, cover up how power actually works and reproduces it. It is also argued that it is impossible to think about these rights solely from the perspective of the written law. Rather, its is necessary to look at the political and economic structures underpinning them, by analyzing the Inter-Aerican System, its ideological stance, its institutional structure and its financing. This article will analyze how power has worked since the Neo-Liberal period started, when a form of government was created in which the State shares the power to create provisions and to apply sanctions with various actors who are not subject to any type of accountability.
