La gestación tras el diagnóstico neurológico de muerte: ¿gestación post mortem?

Abstract

La aplicación del criterio neurológico de muerte en la gestante genera interesantes dilemas éticos y jurídicos. Con independencia de que en tales circunstancias se considere oportuno mantener el cadáver de la progenitora como reservorio natural del feto hasta obtener la viabilidad de este (madre incubadora), nada priva que sea certificada la muerte en el momento en que se diagnostica y con ello su respectiva inscripción en el registro civil con los efectos que en el orden filiatorio y sucesorio conlleva.

Application of the neurological criterion of death to the expectant mother raises significant ethical and legal dilemmas. Regardless of whether is it appropriate or not, under such conditions, to keep the body of the pregnant mother as the foetus’ natural environment until the foetus reaches his viability; nothing prevents that the death of the mother is certified at the time in which the death has been diagnosed and, with it, the certificate’s registration in the civil registry for it to yield all effects in inheritance and filiation matters.
