El nuevo derecho civil y ética de los vulnerables

Abstract

Con el extraordinario aporte del derecho internacional de los derechos humanos la consideración jurídica de la vulnerabilidad se erige en estos tiempos en una insoslayable realidad. El nuevo Código Civil y Comercial consagra al paradigma protectorio hacia los más débiles erigiendo como principio rector, una verdadera ética de los vulnerables. Sin embargo, si se quiere alcanzar la igualdad real que se pregona deberá partirse por redefinir el término, y entonces, vulnerable no se es por pertenecer sólo a una categoría (discapacitado, menor, indígena, mujeres, etc.), sino que es una consideración que invita a promover las propias potencialidades a fin de que pueda superarse el escollo e integrarse al entorno. La reflexión normativa es fundamental en tal sentido.

With the extraordinary contribution of the international law of human rights the legal consideration of vulnerability is built in our times on an unavoidable reality. The new Civil and Commercial Code vests the protecting paradigm of the weakest as the ruling principle, a true ethics of those who are the most vulnerable. However, if the so proclaimed real equality wants to be reached to, redefining the corresponding concept should be the starting point of departure, and thus, it is not considered vulnerable the one who belongs to one category alone (disabled, minor, indigenous, women, etc.), but it is a consideration which invites to promote the self potentialities which will allow anyone to overcome the hurdle and therefore integrate to the environment. A reflective legislation is crucial to that effect.
