Buscando articulaciones posibles: puntos de encuentro y encrucijadas

Abstract

Este artículo forma parte de la investigación en curso de ejecución, Las violencias contra las mujeres, los discursos en juego y el acceso a la justicia, de la que ambas autoras formamos parte. Surge como respuesta a las inquietudes producidas en el proceso de análisis de los resultados del trabajo de campo, puesto en relación con la teoría incorporada. Nuestro trabajo se nutre de los testimonios de las mujeres, con las que venimos trabajando, más allá de este proyecto desde hace veinticuatro años, las entrevistas a funcionarios de la administración de justicia y del Poder Ejecutivo provincial, realizadas en el marco de este proyecto de investigación. Los interrogantes que motivan este trabajo son: ¿frente al aumento de denuncias sobre violencia contra la mujer, la respuesta debe ser sólo crear instancias judiciales cada vez más específicas? ¿Qué medidas producen las instituciones que intervienen en esta problemática para articular sus acciones? Afirmamos que, para materializar la articulación entre los fueros judiciales, el resto de los organismos estatales y las organizaciones de la sociedad civil los actores deben realizar prácticas, de tal naturaleza, que posibiliten establecer relaciones entre elementos de manera que, parte de sus identidades sean modificadas como resultado de dicha articulación y posibilite el nacimiento de nuevas prácticas.

The authors of this article are members of an ongoing research project under the title Violence against women, the discourse at play, and access to justice and the paper reflects on the advances in the field work. It is written in response to the questions arising throughout the process of analysis of the results of field work within the corresponding theoretical framework. The women´s testimonies are the raw material for the analysis. For a period of over 24 years the victims, the officers in the administration of justice and the members of the executive power in the province of Buenos Aires have been interviewed. There are two major questions: 1- Is there a need for the creation of more specific judicial instances, in the light of the ever growing increase in the number of reports filed by victims of familiar violence? 2- Which are the concrete measures taken by the institutions involved in this complex problem in order to join their efforts? In sum, the cooperation between the different judicial bodies, the national organizations and civil society is of paramount importance in order to modify their usual practice. The changes will, in turn, will give birth to new and different ways of facing the issue.
