Abstract

En el presente trabajo se va a realizar el análisis de una cita del Digesto de Justiniano sobre el corte de árboles furtivo de Paul., 9 ad Sab., D.47.7.1 respecto de cuál es el alcance de la aplicación de la Lex Aquilia en la responsabilidad por el daño causado sobre cosa ajena, y su eventual confluencia o superposición con otras normas jurídicas, en éste caso, con la Lex de las XII Tablas de más antigua data, los juristas intervinientes y su obras jurídicas para ubicarlos en un contexto de formación jurídica que han tenido en su época. El objetivo central es buscar una solución jurídica en el contexto tan complejo de la casuística romana. El método que se aplica es el exegético, el más utilizado para el estudio de las normas romanas y por último analizar las normas, posiciones, superposiciones, y el resultado final de aplicación de la norma superadora de la casuística romana.
