El incumplimiento alimentario y el entrecruzamiento de las violencias: económica y simbólica

Abstract

En el presente trabajo se hace una revisión teórico/práctica del incumplimiento de la responsabilidad alimentaria como un factor de victimización del que hace uso el progenitor no conviviente para aleccionar a la mujer, progenitora de sus hijes. También se analizará el tratamiento de ese incumplimiento en el poder judicial y su impacto en las separaciones atravesadas por la violencia. A la luz de los hechos, la práctica tribunalicia demuestra que para el sistema constituye un incumplimiento más, esto, porque tal como se demostrará, en los párrafos siguientes, no lo aborda desde una perspectiva integral y de género. Por lo que, es el mismo Estado el que contribuye a revictimizar a la mujer y a promover la impunidad del victimario – alimentante. El sentir de las personas en situación de violencia de la ONG Quillagua de la ciudad de General Roca, Provincia de Rio Negro, llevó a analizar las prácticas revictimizantes ante el reclamo de la prestación alimentaria, a fin de visibilizar esta realidad en el día nacional de niñas, niños y adolescentes.

In the present work, a theoretical / practical review of the non-fulfillment of food responsibility is made as a victimization factor that the non-cohabiting parent makes use of to instruct the woman, the progenitor of their children. The treatment of this breach in the judiciary and its impact on the separations traversed by violence will also be analyzed. In light of the facts, the court practice shows that for the system it constitutes one more breach, this, because, as will be demonstrated, in the following paragraphs, it does not address it from a comprehensive and gender perspective. Therefore, it is the State itself that contributes to revictimizing women and promoting impunity for the perpetrator - feeder. The feelings of the people in a situation of violence from the NGO Quillagua in the city of General Roca, Province of Rio Negro, led to an analysis of the revictimizing practices in the face of the claim for food benefits, in order to make this reality visible on the national day of girls, boys and adolescents.
