El trabajo en interrupción voluntaria/legal del embarazo desde la salud pública

Abstract

El presente trabajo surge de mi experiencia como residente de Psicología en un dispositivo de Interrupción Voluntaria/Legal del Embarazo en un Hospital General de la Provincia de Buenos Aires. La sanción de la Ley Número 27.610, que entró en vigencia el 24 de enero de 2021 permite el Acceso a la Interrupción Voluntaria del Embarazo (IVE) para todas las personas con capacidad de gestar hasta la semana 14 inclusive, del proceso gestacional; y el derecho a decidir y acceder a la interrupción voluntaria del embarazo a partir de la semana 15 del proceso gestacional bajo determinados causales. Es necesario destacar la complejidad del estado de embarazo de las personas con capacidad gestante, la cual debe ser abordada a través dimensión psicoanalítica, vinculada al deseo materno sin dejar de considerar las vulnerabilidades sociales en las cuales suelen encontrarse quienes acceden a esta práctica. Así, el desarrollo de esta práctica, me lleva a trabajar en la tensión entre el discurso de las leyes y el discurso del psicoanálisis. De este modo la práctica se orienta a través de los ideales institucionales de la “salud para todos”, y también con la singularidad desde la cual nos regimos en tanto psicoanalistas. Ante el cese de causales hasta la semana 14, en el dispositivo surgió el debate respecto a continuar la entrevista con psicología que era llevada a cabo para delimitar los causales. Las preguntas que orientarán el escrito consistirán en: ¿cuál es la especificidad de un psicólogo de orientación psicoanalítica en estos dispositivos? ¿es necesaria la entrevista con psicología? ¿bajo qué fines sería llevada a cabo? A los fines de responder estas preguntas se realizará una investigación entre los marcos legales que rigen la práctica de los psicólogos, los cuales serán puestos en diálogo con los desarrollos del psicoanálisis de orientación lacaniana.

This work arises from the practice of psychoanalysis in an interdisciplinary team for the voluntary/legal interruption of pregnancy in the public health system. The sanction of the Law No. 27,610, which became enacted on 2021, allows the access to the voluntary interruption of pregnancy for all the people who are able to become pregnant up to and including the fourteenth (14th) week of pregnancy. Also, the law allows for the right to choose and have access to the possibility of interruption of pregnancy up to the fifteenth (15th) week in certain cases. It is important to acknowledge the complexity of the state of pregnancy of the people who are able to become pregnant, which must be approached with the psychoanalytic perspective, that includes the desire of the mother and the consideration with the situation of social vulnerability of the women who have access to this practice. The development of this practice, we carry out in the hospital, leads us to work on the tension between the law's discourse and the psychoanalysis’ discourse. In this way, our practice is guided by the ideals of “public health” but also by the singularity by which we work as psychoanalysts. The cessation of casuals until the fourteenth (14th) week established by the law, opens up the question about the continuation of the psychology interviews. In this regard, the following questions will orient the paper: Is it necessary to have an interview with a psychologist? Under which objectives would it be carried out? What is the specificity of a psychologist with a psychoanalytic approach in the interdisciplinary team? In order to answer these questions, research will be performed among the legal boundaries that govern the practice of psychologists, health workers, and patients; articulated with the theory of lacanian orientation.
