En esta ponencia aportaremos algunos insumos que contribuyan a echar luz respecto a la protección jurídica de un sujeto de derecho atravesado por una doble estigmatización: la de género, por una parte; y la de la enfermedad mental, por otra. Partimos de reconocer la situación de desigualdad e inferioridad con la que es dotada la mujer respecto al hombre, como un hecho de dimensiones estructurales que atraviesa el campo jurídico y de la salud.
Nos focalizaremos en las previsiones tenidas en cuenta por la Ley Nacional de Salud Mental (Ley 26.657), sancionada en el año 2010. Al respecto, planteamos la hipótesis que advierte que dicha ley ha sido formulada desde un afianzado paradigma de masculinidad.
Valiéndonos de la tesis de Rawls respecto a lo inequitativo de una tutela análoga a quienes se encuentran en disímiles situaciones, proponemos reflexionar sobre las limitaciones de la mencionada norma para asegurar el acceso a la justicia de las mujeres-“locas” en condiciones de igualdad a los hombres.

In this paper we will provide some inputs that contribute to shed light on the legal protection of a subject of law crossed by a double stigmatization: gender, on the one hand; and of mental illness, on the other. We start from the recognition of the situation of inequality and inferiority with which women are endowed with respect to men, as a fact of structural dimensions that crosses the legal and health field. We will focus on the prospects taken into account by the National Mental Health Law (Law 26.657), sanctioned in 2010.
In this regard, we propose the hypothesis which warns us about that law has been formulated from an entrenched paradigm of masculinity. Based on Rawls's thesis on the inequitable nature of a similar protection to those in different situations, we propose to reflect on the limitations of the aforementioned norm to ensure access to justice for women - "crazy" on equal terms with men.
