El Pacto Internacional de Derechos Económicos, Sociales y Culturales reconoce el derecho de toda persona a un nivel de vida adecuado para sí y su familia, incluyendo alimentación, vestido y vivienda, y obliga a los Estados a adoptar medidas apropiadas para asegurar la efectividad de este derecho. En España, el derecho a la vivienda está reconocido en la Constitución no como verdadero derecho subjetivo, sino como un mandato a los poderes públicos. La construcción del derecho a la vivienda ha suscitado una atención creciente en la doctrina y en la legislación, incluyendo el deber de uso que se impone en determinadas situaciones a los propietarios de viviendas vacías. En el trabajo se exponen los datos legales más relevantes para la configuración del deber de uso y las consecuencias de su incumplimiento, así como su interpretación por la jurisprudencia constitucional. También se reseñan algunas de las medidas fiscales y parafiscales que penalizan la desocupación de las viviendas.

The International Covenant on Economic, Social and Cultural Rights recognizes the right of everyone to an adequate standard of living for himself and his family, including food, clothing, and housing. The Covenant obliges States to take appropriate steps to ensure the realization of this right. In Spain, the right to housing is recognized in the Constitution not as a true subjective right, but as a mandate to the public authorities. The construction of the right to housing has attracted increasing attention in doctrine and legislation, including the duty of effective use imposed in certain situations on the owners of empty dwellings. This paper presents the most relevant legal data for the configuration of the duty of use and the consequences of non-compliance, as well as its interpretation by Constitutional Court. It also outlines some of the fiscal measures that penalize the unoccupancy of dwellings.
