Uso, contaminación y regulación del agua: aspectos generales

Abstract

Entre los años 2020 y 2021 se desarrolló la pandemia provocada por el virus SARS COVID 19. Más allá de sus implicancias globales en múltiples aristas (e.g. sanitarias, económicas, laborales), las poblaciones más afectadas fueron aquellas que se encontraban en situaciones de vulnerabilidad según su lugar socio-ambiental de residencia. Un recurso extremadamente importante para poder sobrellevar la lucha de prevención contra el virus fue el agua, toda vez que la misma resultó indispensable para la limpieza de todo aquello donde pudiera quedar alojado el virus. Este recurso, de ser mal administrado, propiciaría no sólo la expansión del virus COVID-19, sino también la degradación medioambiental, del hábitat de la fauna y la contaminación. En este informe se realizará un recorrido legal y técnico sobre el acceso al agua potable como derecho humano, en base al análisis de normativa internacional y la situación de nuestra región latinoamericana y nacional. Con ello se buscará, como objetivo general de este trabajo, poner en evidencia el estado actual del agua -entendido como recurso natural fundamental para la vida humana- y su legislación en la Provincia de Buenos Aires.

Between 2020 and 2021, the pandemic caused by the SARS COVID-19 virus developed. Beyond its global implications on multiple aspects (e.g. health, economic, labor), the most affected populations were those who found themselves in situations of vulnerability according to their socio-environmental place of residence. An extremely important resource to be able to carry out the prevention fight against the virus was water, since it was essential for cleaning everything where the virus could be lodged. This resource, if poorly managed, would lead not only to the spread of the COVID-19 virus, but also to environmental degradation, wildlife habitat, and pollution. This report will provide a legal and technical overview of access to drinking water as a human right, based on the analysis of international regulations and the situation in our Latin American and national region. With this, the general objective of this work will be sought to highlight the current state of water - understood as a fundamental natural resource for human life - and its legislation in the Province of Buenos Aires.
