Políticas públicas en materia de regularización dominial y la importancia de la colaboración del notariado

Abstract

Partiendo de la premisa de que el título de propiedad es un aspecto esencial del derecho constitucional de acceso a una vivienda digna, realizamos un diagnóstico de la situación argentina actual en materia de titulación de la vivienda en los sectores más vulnerables de la población, destacando la importancia que tienen las políticas públicas en el saneamiento de la titulación y regularización dominial, y la trascendencia de la colaboración del notariado de número en dicha tarea. En tal sentido, enumeramos y explicamos concisamente la legislación nacional y provincial destinada a erradicar dicha problemática, y por último vinculamos la actividad y el aporte realizado por los escribanos, resaltando la función social que incumbe a dicha profesión.

Taking into account the premise that the title deed to prove ownership is an essential aspect of the constitutional right of access to adequate housing, we elaborate a diagnosis of the current situation in Argentina regarding that issue in the most vulnerable sectors of the population. We emphasize the key role of public policy on issuing title deeds and regularization dominial, and the importance of collaboration of notarial number in this task. In this regard, we list and briefly explain the national and provincial legislation aim to eradicate this issue, and finally we associate the activity and the contribution that the notarial number performed in this work, emphasizing the social role of that profession.
