Abstract

Este trabajo se propone caracterizar los llamados obiter dictums, analizar los diversos tipos que se presentan en sentencias de tribunales superiores y señalar sus funciones, beneficios, riesgos y dificultades en especial en el análisis y aplicación de “doctrinas judiciales.

This paper aims at characterizing the so-called obiter dicta, analyzing the various types present in judgments from higher courts and pointing out their function, benefits, risks and difficulties, especially in connection with “judicial doctrine” analysis and application.
