La meticulosidad técnica en la asignatura recursiva, lejos de manifestarse como un mero prurito de exigua importancia, representa un eje esencial del funcionamiento de todo nuestro sistema procesal.
Desde siempre la doctrina del recurso indiferente ha sido enarbolada como una suerte de bastión al servicio de justiciable, que maniobrado por el magistrado posibilitaría la tramitación de un recurso extraordinario, no obstante merecer el mismo su rechazo por padecer vicios que merezcan su declaración de inadmisibilidad.
Propondremos, a partir de un criterioso precedente de la SCJBA, pasar rápidamente revista por los principales lineamientos de la doctrina alemana apuntada, finalizando con un breve comentario del fallo en cuestión, que a nuestro juicio, representa un prudente apuntalamiento de la doctrina legal imperante; la cual, por el momento, desaconseja la introducción pretoriana de dicho instituto.

The meticulous technique in the recursive subject, far from manifesting as merely pruritus of insignificant importance, it represents an essential axis of the functioning of our entire procedural system.
Historically the doctrine of the indifferent recourse has been hoisted as a sort of bastion to the service of the litigant, that operated by the judge would allow the processing of an extraordinary recourse, although a rejection is worthy as a result of the vices that deserve it`s inadmissibility declaration.
We will propose, based on a sensible precedent from the SCJBA to glance at the main lines of the pointed German doctrine, ending with a brief review of the decision in question that to our judge represents a prudent underpinning of the current legal doctrine; which, for the moment, does not advise the praetorian introduction of such institute.
