La violencia familiar judicializada

Abstract

El presente trabajo intenta definir el fenómeno “violencia familiar”, desde una perspectiva epistemológica y en consideración a los diferentes escenarios sociales, culturales y políticos donde se manifiesta o puede manifestarse. Problematizar las interpretaciones jurídicas del fenómeno en torno a la instancia judicial que trabaja la denuncia formulada, -hecho público del acto violento que muta en hecho “judicializado”-; describir sus actores, efectores y operadores y analizar las soluciones jurisdiccionales que se construyen en torno al suceso violento denunciado, en referencia a su precariedad, parcialidad y relatividad, son algunos de los objetivos buscados en el presente análisis. En este sentido, se busca mostrar que más allá de la denuncia formulada en juzgados especializados, defensorías oficiales, fiscalías y/u organismos administrativos/ejecutivos, es necesario un Otro –especializado- que sostenga esa denuncia, con escucha activa, diligencia, empatía y responsabilidad. Se intentará describir un camino que se inicia con la denuncia pero que la trasciende, descripción fundada en las leyes vigentes, en el derecho comprado, en la normativa internacional aplicable y en los casos que forman el corpus de derecho vivo.

This paper tries to define the phenomenon of familiar violence from the perspective of epistemology. The cases of familiar violence are studied taking into account the different social, cultural and political dimensions of the issue. The purpose of this survey is to reflect upon the legal interpretation of the phenomenon once the case is filed at Court. The survey includes the different elements involved: jurisdiction problems, plaintiffs, defendants, victims, judges and officers in the administration of justice. In general, the poor solutions offered are based on their biased relative and partial standpoints. In sum, the mere filing of the complaint at the corresponding courts and organisms in the administration of justice is insufficient to obtain the proper redress .The complexity of the problem and the search for success require the aid of another party: Somebody who is willing to lend an active ear, full of empathy, responsibility and due diligence in the proceedings who conducts the lawsuit to the end. The aim is to describe a path which begins with the filing of the complaint and transcends it: The description is grounded on current laws, compared law international regulations on the matter, case law, jurisprudence which constitute the corpus of the living law.
