El Nuevo Código Civil y Comercial Unificado Argentino establece, en el Art. 1911, una presunción legal iuris tantum respecto de la calidad posesoria de las relaciones de poder. Esta presunción, representa una herramienta útil para superar dificultades de producción y valoración de la prueba de la posesión, así como también, deja atrás debates interpretativos del régimen anterior y ayuda a lograr los objetivos de la Usucapión como modo excepcional de adquirir un derecho real por el transcurso del tiempo. Sin embargo, por su naturaleza, contenido, calidad interpretativa y efectos, existe alguna inquietud sobre la posibilidad de aplicarla de manera inmediata a los procesos en trámite y siendo así, será ello el objetivo de estas líneas, es decir, dilucidar si es posible o no su aplicación inmediata y en su caso, que consecuencias acarrea.

The new Argentinian Unified Civil & Commercial Code prescribes in the article 1911 a legal iuris tantum presumption about possessory quality in the relations of power. That presumption represents a useful tool to overcome difficulties on production and assessment of evidence, as well as also leaves behind interpretative discussions of the old law, helping to achieve the prescription´s objectives as an exceptional way to acquire a real right by pass of the time. However, because of its legal nature, content, interpretative quality and effects, there are some kind of doubts about the possibility of its immediate application on open long prescription trials. Those doubts will be the challenge of these lines in the attempt to find solutions and their consequences.
