De la concepción liberal de la propiedad privada inmueble, a la función social y a la función ecológica

Abstract

Este trabajo presenta la evolución conceptual que tuvo el derecho de propiedad. En primer lugar se rememoran los orígenes a fines del Siglo XVIII del derecho de propiedad como derecho natural y el desarrollo de un concepto de derecho individual, absoluto, perpetuo. En segundo lugar se analiza cómo surgió la primera limitación a esa concepción bajo la fórmula de la función social. Respecto a esta última, el trabajo muestra que no se trata tampoco de un concepto unívoco. En una presentación original del autor se clasifican diversas concepciones en tres grandes opciones que pueden distinguirse por claros efectos o alcances jurídicos diferentes. Finalmente, se plantea la función ecológica de la propiedad como una función aún no claramente definida en forma universal ni normativa y, con reflejo a las tres posturas definidas para la función social de la propiedad, se trata de delinear el alcance que va adquiriendo o puede alcanzar la función ecológica de la propiedad.

This paper presents the conceptual evolution of property rights. In first place, it thinks back to the origins of property right as a natural right and the development of the concept as an individual, absolute and perpetual right at the end of 18th century. In second place, it analyses how the first limitation to this conception arose under the formulation of the social function. In the latter respect, this paper shows it is not a univocal concept either. Doing an original presentation, the author classifies different conceptions into three major options that can be distinguished by clear effects or different legal scopes. Finally, the ecological function of property is considered as a function not yet clearly defined in an universal or normative way, and, reflecting those three positions defined for the social function of property, it is about delineating the scope that it is acquiring or can reach the ecological function of the property.
