Paisaje: Las formas de su regulación jurídica

Abstract

Atendemos una de las formas de regulación del paisaje y de las categorías jurídicas de bienes donde puede insertar. La dispersión de normas para regularlo a partir de la falta de concepto unívoco trae planteos sobre la forma de tutela y en consecuencia la necesidad de establecer su categoría para la mejor gestión y práctica de políticas públicas. Tratamos someramente la falta de unicidad que apoya en conjunción de variados elementos (materiales, inmateriales, ambientales y culturales) de su noción, analizando desde una de las posturas existentes: la que incluye al paisaje en la concepción del patrimonio ambiental cultural, mostrando la importancia de su defensa y de salvaguardar el paisaje como parte de ese patrimonio en la sub categoría patrimonio urbano, que creemos concentra manifestaciones que configuran la identidad de una ciudad, en la que cabe una forma del paisaje, con ejemplo en dos casos de protección uno al patrimonio edificado y otro que asocia al valor que la sociedad, mostrando el llamado Derecho al Paisaje.

We take care of one of the ways of regulating the landscape and the legal categories of goods where you can insert. The dispersion of norms to regulate it from the lack of univocal concept brings up questions about the form of guardianship and consequently the need to establish its category for the best management or to put into practice public policies. We try briefly the lack of uniqueness that supports in conjunction of various elements (material, immaterial, environmental and cultural) of their notion, analyzing from one of the existing positions: the one that includes landscape in the conception of cultural environmental heritage, showing the importance of its defense and to safeguard the landscape as part of that heritage in the urban heritage subcategory, which we believe concentrates manifestations that shape the identity of a city, in which fits a form of the landscape, with example in two cases of protection one to the built heritage and another that associates the value that society, showing the so‐called Right to Landscape.
