La unidad económica: su rol actual para asegurar el desarrollo sustentable del área rural bonaerense

Abstract

A partir de la revisión de los supuestos de sustentabilidad exigidos por el ordenamiento jurídico argentino y teniendo en cuenta los antecedentes legislativos y doctrinarios de la unidad económica como institución propia del Derecho Agrario, se intenta establecer un estado de la cuestión. Luego se revisa la nueva reglamentación del citado instituto y su aplicación en el ámbito de la provincia de Buenos Aires. Frente al panorama trazado nos preguntamos si debería reorientarse el rol de la institución objeto de estudio con fundamento en la necesidad de llevar adelante un ordenamiento territorial del área rural de la provincia de Buenos Aires.

Based on the review of the sustainability assumptions required by the Argentine legal system and taking into account the legislative and doctrinal history of the economic unit as an institution of Agrarian Law, we attempt to establish a state of the issue. Then we revise the new regulation of the aforementioned institution and its application in the province of Buenos Aires. Faced with the outline of the subject, we asked ourselves if the role of the economic unit should be reoriented based on the need to carry out a territorial ordering of the rural area of the province of Buenos Aires.
