Oportunidades para el uso de instrumentos económicos en materia de aguas en México

Abstract

En el presente trabajo se reflexiona sobre las oportunidades en México para el uso de instrumentos económicos en materia de aguas. Tras la reforma constitucional del año 2012, en la que se añade un párrafo sexto dentro del artículo cuarto, es necesario cambiar el marco jurídico aplicable a las aguas en el país y este estudio hace una propuesta de redacción de un capítulo relativo a los instrumentos económicos en dicho ordenamiento jurídico. Se distingue, de acuerdo a lo que dispone la Ley General del Equilibrio Ecológico y la Protección al Ambiente, entre instrumentos fiscales, financieros y de mercado. Por último, se propone la utilización de uno de estos instrumentos, el pago por servicios ambientales, para fomentar el trasvase entre cuencas.

In this paper we examine the opportunities in Mexico for the use of economic instruments on water regulation. After the constitutional reform of 2012 is necessary to change the legal framework for water in the country and this study makes a proposal for drafting a chapter on economic instruments in that law. We distinguish, according to the provisions of the National Law of Ecological Equilibrium and Environmental Protection, tax, financial and market instruments. Finally, the use of one of these instruments (paying for ecological services) is proposed to promote inter-basin transfers.
