Ellos maltratan pero cuidamos sus derechos. Y los de ellas, ¿quién los cuida?

Abstract

El presente trabajo indaga sobre los mecanismos de protección jurídica en la Argentina, en relación a la problemática de la violencia de género, y cómo en nombre de dicha protección, se generan también un sinnúmero de violencias institucionales, producto de acciones u omisiones realizadas por el Estado y sus agentes. Para ello, se analiza – a manera de caso testigo - la ruta crítica y el posterior devenir institucional de una mujer en situación de violencia y cómo el tratamiento judicial del fenómeno, traspasado por prácticas androcéntricas y estereotipos de género, produce resultados que pueden ser definidos como violencia institucional. El recorrido aspira a desnaturalizar prácticas jurídicas y otras intervenciones del Estado ancladas en concepciones ritualistas y supuestamente neutrales, la trama tejida en torno a un complejo proceso de desmaterialización de las violencias, donde lo sustantivo pierde valor y las víctimas se constituyen en las grandes ausentes, negadas en su sufrimiento y su palabra, especialmente aquellas atravesadas por múltiples vulnerabilidades, y que recurren al servicio jurídico gratuito.

This paper investigates the mechanisms of legal protection in Argentina in relation to the problem of gender violence and how in the name of such protection also generates a number of institutional violence, product of actions or omissions made by the State and its agents. To this end, we analyze - as a witness case - the critical path and subsequent institutional evolution of a woman in a situation of violence and how the judicial treatment of the phenomenon, transcended by andro-centric practices and gender stereotypes, produces results that can be defined as institutional violence. The course aims to denaturalize legal practices and other interventions of the state anchored in ritualistic and supposedly neutral conceptions, the web woven around a complex process of dis-materialization of violence, where the substantive loses value and the victims become the great absentees, denied in their suffering and their word, especially those crossed by multiple vulnerabilities and that resort to free legal service.
