Consideraciones sobre la reciente legislación argentina en lo referente al consentimiento informado y la autonomía progresiva en investigaciones con niños

Abstract

Esta comunicación se realiza en el marco de una beca CIN-UNLP, vinculada al proyecto de investigación El consentimiento informado en investigaciones psicológicas con niños. Consideraciones ético-normativas, cuyo objetivo principal se orienta a revisar y analizar la especificidad que adquiere el consentimiento informado (CI) y el asentimiento en investigaciones psicológicas con niños. En ese encuadre, el propósito general del plan de beca consiste en indagar, en el ámbito del Derecho, los cruces posibles entre el principio de autonomía progresiva que se le atribuye al niño en desarrollo y la nueva legislación civil y comercial de la Nación Argentina. Específicamente, la propuesta refiere a analizar en las normativas nacionales e internacionales –focalizando en las primeras-, las posibilidades de los niños, niñas y adolescentes de brindar CI o asentimiento para ser sujetos partícipes de investigaciones.

The present work is carried out within the framework of a CIN-UNLP scholarship, which purpose is to investigate, within the scope of the law, possible relationships between the principle of progressive autonomy attributed to the developing child and the new Civil and Commercial Argentine legislation, especially in relation to the possibilities of providing Informed Consent to be a participant in research. It aims to analyze the new system of "progressive capacities" through which the possibilities of exercising rights and autonomy to make decisions are gradually acquired. This is expressed in Articles 22 to 50 of the new Civil and Commercial Code of the Nation (Law 26,994, HCNA, 2014), specifying in which cases children may perform the act of consenting or assenting by themselves, accompanied by consent and assent of one of the parents and / or both. A theoretical study of bibliographic review and updating is proposed through the methodology of qualitative content analysis (construction and testing of categories for the analysis and comparison of documents). Based on the sources analyzed, the results and conclusions established so far are presented.
